(Parking Places) Bye-Laws 2008
In respect of the Town of Carrick-on-Shannon.
Leitrim County Council (hereinafter referred to as “the Council”) in exercise of the powers vested on them by Section 36 of the Road Traffic Act, 1994 (No. 7 of 1974) and having consulted with the Commissioner of the Garda Síochána, hereby makes the following Bye-Laws:-“
Short Title/
Citation: 1. - These Bye-Laws may be cited as the Leitrim County Council (Parking Places) Bye-Laws, 2008 in respect of the Town of Carrick-on-Shannon.
Commencement: 2. - These Bye-Laws shall come into operation on the 11th August, 2008.
Area of Application:3. - These Bye-Laws apply to the area comprising the town of Carrick-on-Shannon in the administrative area of County Leitrim, as delineated in the map attached hereto
Repeals: 4. - The Leitrim County Council Parking Places Bye-Laws 2005 in respect of the town of Carrick-on-Shannon are hereby revoked.
Interpretation: 5. - In these Bye-Laws:
“Act of 1994” means the Road Traffic Act, 1994 (No. 7 of 1994)
“disabled persons parking bay” means a space intended for the parking of a mechanically propelled vehicle in which is displayed a disabled persons parking permit
“disabled persons permit” means a permit issued under Article 43 of the Regulations of 1997
“the Regulations of 1997” means the Road Traffic (Traffic and Parking) Regulations 1997 (S.I. No. 182 of 1997)
“the Regulations of 1997 (Amended)” means the Road Traffic (Traffic and Parking) (Amendment) Regulations, 1998 (S.I. No 274 of 1998)
“the Regulations of 1998” means the Road Traffic (Traffic and Parking) (Amendment) (No.2) Regulations, 1998 (S.I. No.441 of 1998)
“the Signs Regulations of 1997” means the Road Traffic (Signs) (Amendment) Regulations 1997 (S.I. No. 181 of 1997)
“the Regulations of 1997 (Amended)” means the Road Traffic (Signs) (Amendment) Regulations, 1998 (S.I. No. 273 of 1998)
“business hours” means the period from 8.30 a.m. to 6.30 p.m. on a weekday from Monday to Saturday inclusive ( excluding public holiday) which is not a holiday
“holiday” means Good Friday or any day that is a Public Holiday for the purposes of the Organisation of Working Time Act, 1997
“Loading bay” means that portion of a road indicated by means of a traffic sign on which, at certain times, a vehicle, other than a goods vehicle being used for loading or unloading, shall not be parked
“parking disc” means a disc or document, or a combination of both, issued by a local authority whether obtained by means of a disc parking machine or otherwise and having marks or symbols capable of indicating the year, date and time when the disc document or combination becomes a valid parking disc
“valid parking disc” means a parking disc which
(a) has been issued by Leitrim County Council
(b) has been perforated or otherwise marked as appropriate to the particular type of parking disc, so as to indicate clearly the year, month, day in the month, hour of the day and minute of the hour of the commencement of a period of parking of the vehicle in which the parking disc is exhibited in accordance with these Bye-Laws
(c) indicate no other year, month, day, hour or minute and,
(d) indicates that the vehicle is so parked for a period for which it may be parked in a disc parking place in accordance with these bye-laws.
“Resident” means a person who is the occupant of a dwelling and who satisfies the Council that his or her normal dwelling place is situated in a street within the pay-parking area and which dwelling has no access to private parking within the confines of the dwelling place.
“Residents Parking Permit” means a document issued by Leitrim County Council or its agents for the purpose of these bye-laws.
Specification of
Parking Places The following locations (as delineated on the map attached at Schedule 1) shall represent the locations within the town of Carrick.on.Shannon where paid parking shall apply based upon the display of a valid parking disc.
Main Street.
Commencing at Main Street/Dublin road junction travelling west and southwest on Main Street
Right handside.
(1). From a point 28.7m east of Leitrim Road junction (R280) to a point 9.5m east of said junction.
(2). From a point 8.2m west of Leitrim Road junction (R280) to a point 7.4m east of Priests Lane junction.
(3). From a point 8.2m west of Priests Lane junction to a point 36.5m.
northeast of junction with Church Lane.
(4). From southwest side of Church Lane junction s/w to a point 3m n/e of the southwest boundary of St. Mary’s Church.
Commencing at Main Street/Dublin road junction travelling westwards on Main Street
Left handside.
(5). From a point 12.8m west of entrance to presentation house (building line of Kelly’s premises) all along Main Street to Town Clock and junction with Bridge Street, excluding the Box Junctions at Priests Lane junction & Church Lane junction, and also excluding loading bay and entrances.
Church Lane
Commencing at Main Street junction travelling n/w
Left handside.
(1) From a point 6.7m from building line of main street n/w for a distance of 50.2m.
Commencing at Main Street junction travelling n/w
Right handside.
(2) From a point 25.2m from building line of main street n/w for a distance of 32.7m, excluding Loading bay.
Priests Lane.
Commencing at Main St junction travelling northwards on

(1) From a point 29.3m n /w of the n/w gable of Park Lane House for a distance of 38m.
Link Road from Leitrim Road to Priest’s Lane.

(1) From a point 14.9m. from Leitrim road junction, westwards for a distance of 45.6m.

(1) From a point 59.8m from junction with Main Street, northwards for a distance of 24.4m.
Summerhill Road.
Commencing at Main St. /Dublin Rd. junction travelling northeast on
Left hand side.
(1) From a point 20m. n/e projected n/e side of the Dublin Road northeast for a distance of 32m.
Commencing at Main St. /Dublin Rd. junction travelling northeast on
Right hand side.
(2)From a point 19.7m from junction with Dublin Road, n/e for a distance of 36m.
Dublin Road.
Commencing at Main St. /Dublin Rd. junction travelling southeast on

(1) From a point 16.5m from junction with Summerhill Road, s/e to the n/w boundary wall of entrance to Marymount (Old Convent)

(2) From a point 80.3m n\w of junction with Shannon Lodge Road, s/e for a distance of 24.7m.
Bridge Street.
Commencing at Main Street/Bridge Street junction (Town Clock) travelling southwards on Bridge Street

(1). From a point 44.6m north of Quay Road junction southwards to a point 10m north of the said junction.
(2). From a point 25m south of Quay Road junction continuing southward for 29m.
Commencing at Main Street/Bridge Street junction (Town Clock) travelling southwards on Bridge Street

(3). From Town Clock / Main St. junction, to a point 25m north of N4 Junction (building line of Coffeys) excluding loading bay, full time Taxi Rank, part time Taxi Rank between 19.00 and 07.00 hours and entrances.
Quay Road.
Commencing at Quay Road/Bridge Street junction travelling West & North on Quay Road
Right handside.
(1). From a point 12m west of main building line of Bridge Street continuing westward for 31m.
(2). From the n\w boundary of Town Hall site to a point 10m southeast of St. George’s Terrace Junction, Right hand side and entrances.
St. George’sTerrace.
Commencing at Quay Road/St. George’s Terrace junction travelling northeast
Right handside.
(1). From a point 4m east of Quay Road junction for a distance of 41.3m.
Commencing at Quay Road/St. George’s Terrace junction travelling northeast
Left handside.
(2). From a point 5m n/e of projected n/e side of Quay Road, continuing Eastward to a point 1m. s\w of the northeast gable of Post Office excluding part time Taxi Rank between 19.00 and 07.00 hours.
Commencing at Quay Road/St. George’s Terrace junction travelling southwest.
Left handside.
(3) From a point 7.2m. s /w of Quay Road to a point 2.6m. n /e of Old Courthouse boundary wall excluding Casual Trading Bay on specified days.
Commencing at Quay Road/St. George’s Terrace junction travelling southwest.
Right handside.
(4) From a point 6.7m. s /w of projected s/w side of Quay Road to a point 1.5m. n /e of Old Courthouse boundary wall.
Carrick.on.Shannon Quays
In designated parking bays from northern boundary of Carrick Rowing Club grounds, south and southeast (both sides of bridge) to junction with N4 By-Pass adjacent to Public Toilet Block.
Part Time Appointed Stands
Part time appointed stands shall be locations where paid parking will apply during business hours.
Notes:
(1). Where the description refers to a junction the distance involved is measured from the nearest building/property boundary line.
(2). Excludes rear entrances where these can be used for vehicle access.
Restrictions 6. (a) This Bye-Law shall apply (at locations identified above) during business hours, i.e., from 08.30 to 18.30 from Monday to Saturday, inclusive.
(b) A vehicle parked in a Disc Parking Place during business hours shall not be so parked for longer than the period indicated as the maximum parking period for that Disc Parking Place by means of an authorised information plate accompanying traffic sign Number RUS-018 authorised by the Regulations of 1997.
(c) Where a vehicle is parked in a Disc Parking Place during business hours a person shall not interfere with a valid parking disc exhibited in the vehicle
(d) A vehicle parked in a Disc Parking Place at a time which is not during business hours shall be removed from the Disc Parking Place when a period of business hours commences, unless at such commencement and during the remainder of the period of parking, a valid parking disc is exhibited in the interior of the vehicle.
(e) A vehicle which had been parked in a Disc Parking Place shall not be parked again in a Disc Parking Place in the public road in which that Disc Parking Place is situated until at least one hour after the vehicle last vacated that Disc Parking Place.
(f) A motor cycle or pedal cycle shall not be parked during business hours in a Disc Parking Place.
Disc Parking Fee 7(a). - The fee for a parking disc shall be €0.20 for fifteen minutes and €0.80 per hour within business hours, subject to the maximum period as per 6(b) above.
(b) For the purposes of security or construction works only, a weekly parking disc can be purchased at Leitrim County Council, Áras an Chontae, Carrick.on.Shannon, at a cost of €20.00 per week.
Display of
Parking
Disc. 8.(a) A vehicle parked in a Disc Parking Place, during business hours, shall have exhibited in the interior of the vehicle a valid parking disc for the period parked.
(b) The valid parking disc shall be so exhibited in the interior of the vehicle that a person outside the vehicle can ascertain by reference to the perforations or markings when the parking commenced and shall be so exhibited for so long as the vehicle is parked in that Disc Parking Place.
Offences 9. A person who contravenes any part of these Bye-Laws shall be guilty of an offence in accordance with the said Section 36 of the Road Traffic Act 1994.
Exemptions 10. - The provisions of these Bye-Laws shall not apply to
(a) A fire brigade vehicle, an ambulance or a vehicle being used by a member of the Garda Síochána or a member of the Defence Forces in the performance of duty, as such member.
(b) A vehicle being used in connection with the removal of an obstruction to traffic, the maintenance, improvement or reconstruction of a public road, the provision, alteration or repair of a main drain, pipe or apparatus for the supply of water, oil, gas, electricity or of a telecommunications line or the provision of a traffic sign.
(c) A vehicle displaying a “disabled persons permit” parked in an area reserved for such parking.
(d) A vehicle parked while goods are being loaded in or on to it or unloaded from it, for a period not exceeding thirty minutes from the commencement of the parking.
(e) A vehicle parked at the edge of a roadway while a passenger is entering or leaving it.
(f) A vehicle which has been damaged or has broken down, during the period necessary to effect repairs to the vehicle or remove it from the location.
