Carrick-on-Shannon Taxi Stand Bye-laws 2008.
Leitrim County Council in exercise of the powers vested on them by Section 84 of the Road Traffic Act 1961, as substituted by Section 15 of the Road Traffic Act 2002, hereby make the following Taxi Stand Bye-laws in respect of the area comprising the Town of Carrick-on-Shannon.
These Bye-laws may be cited as the Carrick-on-Shannon Taxi Stand, Bye-laws 2008
These Bye-Laws shall come into operation on the 11th August, 2008.
3. The Carrick.on.Shannon Taxi Stand Bye-Laws 2007:
are hereby revoked.
4 Area of Application:
These Bye-laws apply to the area comprising the town of Carrick-on-Shannon
5. Interpretation in these Bye-laws:
(a) “Schedule” means the schedule to these Bye-laws
(b) “Street” means a public road
(c) A reference to the head of an appointed stand shall be construed as a reference to that end of the appointed stand at which an information plate indicating First Taxi is erected.
(d) A reference to the order of street service vehicles at an appointed stand shall be construed as a reference to the order of the vehicles reckoned from the head of the appointed stand to the rear of the appointed stand.
6. Appointment of Appointed Stands:
(a) Subject to these Bye-laws, the locations identified on the map attached at Schedule 1, shall be available for use as appointed stands on a full time basis or a part time basis.
(b) Part time appointed stands, shall be available for use between the hours of 19.00 and 07.00.
7. Position of Vehicles on Appointed Stands:
A street service vehicle standing for hire at an appointed stand shall be placed:
(a) Within the limits of the appointed stand as specified in Schedule 1.
(b) In case there is no street service vehicle already at the appointed stand and, in any other case, next in order to the street service vehicle at the appointed stand and as near as practicable to the street service vehicle, directly in front.
(c) A street service vehicle standing for hire at an appointed stand shall be placed in single line by the kerb and parallel to the kerb and a vehicle shall not be placed more than 45 centimetres from the kerb.
(d) A street service vehicle shall be deemed for the purposes of these Bye-laws, not to be standing for hire at the appointed stand, unless it complies with this Bye-law.
8. Maximum Number of Street Service Vehicles at an Appointed Stand:
(a) The number of street service vehicles standing for hire shall be as delineated in the map attached at Schedule 1.
(b) Wherever a street service vehicle vacates its position at an appointed stand, it shall be replaced by the street service vehicle (if any) next in order at the stand.
9. General Provisions relating to Appointed Stands:
The following provisions shall apply to street service vehicles standing for hire at an appointed stand.
(a) Neither the driver of a street service vehicle nor any other person shall make any unnecessary noise by means of or in relation to the vehicle or the engine or any equipment, fittings, or instruments fitted to or carried on the vehicle or any loud speaker in or in any way connected with the vehicle.
(b) Neither the driver of a street service vehicle nor any other person shall wash, overhaul, or execute repairs to such a street service vehicle, except such repairs as may be necessary to enable the vehicle to be removed from the appointed stand.
(c) The driver of a street service vehicle shall comply with any directives given to him or her by a member of An Garda Siochana, in relation to placing of the street service vehicle at the appointed stand or the bringing of the street service vehicle into or the removal of the street service vehicle from the appointed stand.
10. General Restrictions on Street Service Vehicles standing for hire:
(a) A driver of a street Service vehicle shall not stand the street service vehicle for hire otherwise than at an appointed stand and in accordance with these Bye-laws.
11. Alternative Appointed Stands:
(a) An existing appointed stand may be temporarily suspended by executive order to facilitate construction / development / maintenance of a roadway or footpath or for any other traffic management purpose and an alternative location may be designated as an alternative temporary stand.
